Detailed examples with the categories of violations

At low, medium and high risk as well as anti-social behavior with corresponding fines and sanctions, the offenses are separated with the new Road Traffic Code which the Ministry of Infrastructure and Transport put up for public consultation under the title: “New sanctioning framework of the Road Traffic Code and other provisions for safe mobility”.

The public consultation will be valid until January 24, 2025, while the validity of this will begin 3 months after its publication in the Government Gazette, unless otherwise specified in the individual articles.

In particular, the ministry lists examples of the categories of the new Road Traffic Code (KOK) as well as the new charges.

In detail:

Low-risk offenses carry a fine of 30 euros and concern:

Violation of a red pedestrian light (by a pedestrian).

Failure to allow sufficient space for the passage of an uphill vehicle, on steep roads, where the passage of oncoming vehicles is impossible or difficult.

Abnormal opening of vehicle doors.

Driver of a vehicle not carrying the required documents (the fine is imposed for each missing document).

(30 euros – 30 days driver’s license suspension)

Violation of regulatory signs: Horning is prohibited [εκτός για αποφυγή δυστυχήματος]Mandatory bicycle crossing road [απαγορευμένης της διέλευσης άλλων oχημάτων]), Mandatory pedestrian crossing, Exclusive bus or trolley crossing.

Crossing Offences – Driving in a lane that has markings or words or symbols on the road, such as buses, taxis and bicycles, if they are not driving vehicles of that category

Not granting priority for the passage of public transport, bicycles or mopeds.

Parking a vehicle on the road in front of the entrance to hospitals, clinics and first aid stations in general.

(30 euros – 10 days driver’s license suspension)

Not using or not using direction indicators (flashers) before maneuvering.

Not reducing speed in the face of a vehicle intending to change direction.

Prolonged use of horn.

Causing traffic hazards when towing vehicles.

Violations of medium risk (150 euros) concern:

* A driver puts into circulation and drives a means of transportation or other use that is not defined in par. 2 of article 2 of the Code of Civil Procedure.

* Exceeding the speed limit up to 20 km/h.

(150 euros – 30 days driver’s license suspension)

* Traffic in squares, pedestrian streets, sidewalks, safety islands, etc.

* Use of emergency lane (LEA), excluding vehicle immobilization due to breakdown or other cause.

* Stopping or parking a vehicle on a crossing ramp for people with disabilities or a blind driver and at a distance of less than 0.50 m. on either side of them and in parking spaces exclusively for the disabled.

* Driver behavior that may endanger pedestrians.

* Impeding emergency cars.

(150 euros – 20 days driver’s license suspension)

* Failure to comply with the instructions and signals of traffic controllers

* Violation of the prohibition of crossing

* Overtaking causing danger or obstructing traffic and without timely warning

* Exceeding the speed limit by more than 20 km/h (and up to 30 km/h)

* Failure to provide three-wheeled vehicle, motorcycle and moped passenger vehicle I.X and truck up to three and a half (3.5) tons with suitable tires

(150.00 euros – 50 days driver’s license suspension)

* Non-facilitation of tram traffic.

Violations of high risk include a fine of 350 euros and concern:

* Depositing or abandoning or discarding objects or materials on the streets, which obstruct, even minimally, the traffic of pedestrians and vehicles, as well as the parking of vehicles and/or substances or materials, which can make the street slippery (eg waters, oils, lime, etc.).

* Dumping of soil or waste materials on the street (pavements, footings, sidewalks, footpaths, ditches, etc.)

* Temporary or permanent occupation of a part of the road surface with facilities or obstacles, especially if they impede traffic, the permitted stopping or parking of vehicles or limit the visibility of those using the roads

* Driving with an expired Certificate of Professional Competence (PEI).

(350 euros – 30 days driver’s license suspension)

* Not wearing a seat belt – Helmets (driver)

* Not granting priority to a railway or tramway vehicle

(350 euros – 30 days removal of driver’s license and vehicle registration data)

* Change in the tachograph mechanism

* Transportation of containers that are not secured and secured with appropriate keys (locks) integrated in the vehicle.

* Overdue presentation of a vehicle for regular or emergency technical inspection (except trucks) (removal of traffic data is imposed on the owner)

* Motor vehicle traffic without inventory and classification (except trucks)

* Registration number plates not clearly visible, unrecognizable by technical means or with non-reflective material on them.

(350 euros – 30 days driver’s license suspension)

* Mobile phone use

* Exceeding speed limit

− over 30 km/h,

− more than 150 km/h on a highway,

− over 130 km/h on an expressway,

– over 120 km/h on the rest of the road network

* Causing danger, obstructing traffic

* Not granting priority

* Reverse on motorways and expressways

* Driving under the influence of alcohol.

(350 euros – 60 days driver’s license revocation and 30 days revocation of vehicle registration information)

* Emission of pollutants or noise beyond the permitted limits

(350 euros – 60 days driver’s license suspension)

* Not stopping before a level crossing without barriers or light signaling with markings

(350 euros – 30 days driver’s license suspension and 30 days vehicle registration suspension & imprisonment)

* Falsification, alteration of chassis and engine identification data

* Traffic and driving without a license.

(350 euros – 30 days driver’s license suspension & prison sentence)

* Refusal to stop a vehicle on the instructions of a traffic warden

* Entering and driving without a license (agricultural machine, construction machine) or one that has been removed

* Change of owner or main vehicle characteristics without a new license

* Driving without a valid Greek license of the appropriate category or which has been revoked or removed for any reason

Violations of Special Consequences for Road Safety (Category E4) include a fine of 700 euros and withdrawal of the driver’s license for 30 days and concern:

(700 euros – 30 days driver’s license suspension)

* 4 (3) Violation of regulatory sign: P-2 (Mandatory stoppage) STOP

* 6 (1) Violation of a red light

* 12 (8) Driving road vehicles for demonstration of skill, impressment, competition or making of improvised races. (against) &

* 19 (5) Competition of drivers at speed (againsts)

* 17 (3) Overtaking

(para. a’) when one of the drivers following the one he intends to overtake has already started overtaking

(c.b’) when the driver ahead in this traffic lane signals that he intends to overtake another

(c. e’) immediately before or on a level crossing without movable barriers, unless road traffic is regulated by traffic lights, such as those used at level road junctions.

(c.f) immediately before or at a pedestrian crossing, which is marked as a pedestrian crossing on the road surface or by a sign

(approx. g’) inside the tunnels with one traffic lane in each direction

* 17 (4) Overtaking

on a two-way road surface and when approaching a curved change of slope or in bends with insufficient visibility, unless there is a dividing island at these points or at least two traffic lanes in the direction of the person overtaking, which are defined by longitudinal markings, while overtaking is done without the driver leaving the traffic lanes marked as closed for oncoming traffic.

* 20 (12) Exceeding speed limit

over 50 km/h

(700 euros – 90 days driver’s license suspension)

* 42 (7) Alcohol

(approx. b’) Driving under the influence of alcohol, blood concentration (exhaled air): 0.80 g/l to 1.10 g/l (0.40 mg/l to 0.60 mg/l)

Offense category E4 & (p)

(1,200 euros – 180 days driver’s license suspension & a prison sentence of at least two (2) months) & [(1) Ακινητοποίηση οχήματος υποχρεωτικά και φύλαξη του, σύμφωνα με τις διατάξεις του άρθρου 46 του ΚΟΚ και των, κατ’ εξουσιοδότηση αυτού, εκδιδόμενων αποφάσεων. (42 §7, περ.δ.) (2) Η ΑΟ επιστρέφεται μετά την παρέλευση συνολικού χρόνου αφαίρεσής της, μόνο με την προσκόμιση αποδεικτικού καταβολής του διοικητικού προστίμου ή διακανονισμού.]

* (6) Refusal to submit to a test to establish the presence of alcohol in the body, either through blood sampling or using a breathalyzer device (it is assumed that the concentration of alcohol in his blood is over 1.10 gr./l. according to the method of blood drawing – the sanctions of paragraph c’, of par. 7 of article 42 of the Code of Criminal Procedure))

* 42 (7) Alcohol

(c. c’) Driving under the influence of alcohol, blood concentration (exhaled air): over 1.10 g/l (>0.60 mg/l )

(1,500 euros & prison sentence up to twelve (12) months)

* 9 Failure to place, maintain markings for works carried out on the streets and failure to remove after completion means of marking works carried out.
